Drive of Your Dreams Promotion

This Promotion is open to legal residents of the United States (except residents of Alaska, Hawaii, Maryland, New Jersey, Delaware, Virginia and Puerto Rico and other U.S. territories and possessions) who are of legal age of majority in their jurisdiction of residence (and at least 18 years of age) (19 or older if a resident of Alabama or Nevada or 21 in Mississippi) who have an active and valid email address at time of entry. Employees of Sponsor, Marketing Drive LLC, Rivet, and the Documentary Channel, Inc. and their respective parent companies, affiliates, subsidiaries, agents, agencies, suppliers, distributors and retailers, and members of their immediate families (defined for these purposes as including parents, spouses, children, siblings, grandparents, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to enter or win. Proof of eligibility may be required. Promotion is subject to all applicable federal, state and local laws.

1. Promotion begins at 12:00:01 a.m. Eastern Time ("ET") on March 16, 2009 and ends at 11:59:59 p.m. ET on May 15, 2009 ("Promotion Period"). Proof of entry submission will not be deemed proof of receipt by Sponsor or Administrator. Promotion will be divided into eight (8) weekly entry periods (each, a “Weekly Entry Period”). For the purposes of this Promotion, a week will begin at 12:0:01 a.m. ET each Monday and end at 11:59:59 p.m. ET the following Sunday, with the exception of the last week, which will end at 11:59:59 p.m. ET on Friday, May 15, 2009.
2. To enter, follow the directions provided to register online at http://www.driveofyourdreams.com with all required information and submit as instructed on-screen. Limit one (1) such registration per person and per email address. Registrations received from any person or email address in excess of the stated limitation will be void. At time of registration, participants will receive one entry into the Promotion. Once registration has been confirmed, participants will be able to sign into their account during the Promotion Period. For each Weekly Entry Period, a video clip and two (2) multiple choice quiz questions will be posted. Participants will have the opportunity to view the video clip and answer all multiple choice questions. Once the correct answers have been submitted, a participant will receive one (1) entry into the Promotion for each question answered (for a total of two (2) entries). Participants will have the opportunity to answer each question until they answer it correctly, as determined by Sponsor in its sole discretion. The video clips and quizzes for each Weekly Entry Period will be posted until the end-date of the Promotion Period, giving all participants an opportunity to answer each posting, regardless of when the participant registers. Registered participants will have the opportunity to log in and answer the new questions or to answer unanswered questions from previous Weekly Entry Periods if they have not done so. Limit one (1) entry for each correctly answered question, per person and per email address (for a total of two (2) entries per Weekly Entry Period via this method). Entries received in excess of the stated limitation from any person or email address will be void. All entries must be received in accordance with these Official Rules by 11:59:59 p.m. ET on May 15, 2009 to be eligible.
3. In the event of a dispute as to the identity of an entrant, entries will be deemed made by the authorized account holder of the email address submitted at the time of entry and he/she must comply with these Official Rules. "Authorized account holder" means the natural person who was assigned the email address by an Internet access provider, service provider or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winner may be required to provide proof to Sponsor that he/she is the authorized account holder. Sponsor reserves the right to void all entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and entries made by any method which subvert the entry process and to disqualify any individual using such a method. Released Parties (as defined below) are not responsible for: (i) electronic transmissions or registrations, answers or entries that are lost, late, stolen, incomplete, damaged, delayed, garbled, destroyed, misdirected or not received by Sponsor or its agents for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or network, typographical, printing, mechanical, electronic or human error that may occur in the transmission, receipt or processing of entries, registrations or answers, or for destruction of or unauthorized access to, or alteration of, registrations, answers or entries; (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Promotion; (iv) any entries submitted in a manner not expressly allowed under these Official Rules; (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in this Promotion; (vi) any typographical, printing or other error or problem in any printing or advertising related to this Promotion, in the administration or execution of this Promotion, in the processing of entries, registrations or quiz answers, or in the announcement of prize winners or the prizes; or (vii) cheating or fraud or non-sportsmanlike behavior by any participant. All incomplete or non-conforming entries will be void. All entries become Sponsor's property and will not be returned. If for any reason this Promotion cannot be executed as planned by any causes, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Promotion (or portion thereof), or if this Promotion (or portion thereof) is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right to terminate this Promotion. If this Promotion is terminated before the original end date, Sponsor will select the winners by random drawing from among all eligible, non-suspect entries received as of the termination time and date. Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process or who enters using any automatic or programmed entry duplication method that is prohibited under these Official Rules (and void all associated entries). CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR OTHERWISE CORRUPT OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
4. (2) Grand Prizes: A trip to Birmingham, Alabama for winner and one (1) guest to attend Porsche Sport Driving School North America, scheduled to take place on August 1, 2009 and August 2, 2009. Trip includes hotel accommodations consisting of one (1) standard double occupancy room for four (4) days/three (3) nights; $200 in spending money for the Winner only (awarded as a check); round trip, coach air transportation from a major U.S. gateway airport nearest winner’s residence, and ground transportation will only be provided to and from the airport and hotel in Birmingham, AL and two (2) tickets (for the Winner ("Winner") and one (1) guest (“Guest") to the Porsche Sport Driving School North America. Winner and Guest must be at least 21 years of age and must execute and return a liability/publicity release and any other documents required by Sponsor prior to issuance of travel documents. Approximate Retail Value ("ARV") of prize package: $5,005.50 each. (20) First Prizes: Documentary Channel “Best of DOC” DVD box set. ARV: $50 each. (300) Second Prizes: A Mobil 1 hat. ARV: $15.95 each. Total ARV of all prizes: $15,786. All prize details are at Sponsor’s sole discretion.
5. Grand Prize Conditions: Each Winner and his/her Guest must travel together on the dates and times specified by the Sponsor. Travel and/or accommodations restrictions may apply. Dates of travel and all travel arrangements are subject to availability and may change. Actual retail value of Grand Prize depends on the city of departure and airfare fluctuations, and any difference between the stated ARV and the actual value, if any, will not be awarded. The Winner and Guest must travel together on the same itinerary. Travel arrangements must be made at least thirty (30) days in advance of departure date. The trip may not be combined with any other offer, and travel may not qualify for frequent flyer miles. If Winner resides within one hundred (100) miles of Birmingham, AL, he/she will receive the use of a rental car (subject to age or other eligibility restrictions that may apply by car rental contract) in lieu of air travel (and no compensation or substitution for difference in prize value will be awarded). If Winner does not meet rental car requisites/requirements, that portion of the prize will not be awarded and Winner will be responsible for transportation to/from Birmingham, AL. All other expenses and costs associated with prize acceptance and use not expressly listed above as being provided, including but not limited to income, federal, state and local taxes, luggage fees, insurance, meals, additional ground transportation, souvenirs and tips, are solely the Winner's responsibility. Tickets are subject to certain terms and conditions specified thereon. Seat locations will be determined by Sponsor. Each Winner and his/her Guest agree to comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of prize.
6. General Prize Conditions: Prizes are awarded “as is” with no warranty or guarantee, either expressed or implied by Sponsor. Prizes (or portions thereof) may not be transferred, assigned, redeemed for cash or substituted, except that the Sponsor may substitute a prize with a prize (or portion thereof) of comparable or greater value at its sole discretion. All income, federal state and local taxes on prizes and any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the winners' sole responsibility. Winner will be issued an IRS Form 1099 for the value of the prize. If any potential Winner cannot accept his/her prize as stated, or if he/she fails to use the prize on the specified dates (if applicable) or if he/she is found to be ineligible, or if he/she do not comply with these Official Rules, or if Sponsor is unable to contact such potential Winner within a reasonable time period or if prize or prize notification is returned as undeliverable, then the corresponding prize will be forfeited in its entirety and may be awarded to an alternate winner, time permitting, and at Sponsor’s sole discretion.
7. On or around May 29, 2009, The Documentary Channel, Inc., the Promotion Administrator ("Administrator") will conduct a random drawing from among all eligible entries received, during the Promotion Period to select the potential prize winners. Odds of winning a prize depend on the number of eligible entries received. Administrator is independent of Sponsor, and Administrator's decisions are final and binding in all matters relating to this Promotion. The potential prize winners must comply fully with these Official Rules in order to win and receive their respective prizes. Potential winners will be contacted by telephone, mail, express courier and/or email, and may be required to complete, sign and return an Affidavit of Eligibility and Liability/Publicity Release where prohibited) and any other documents that may be required by Sponsor or prize supplier within ten (10) days of date of initial written notification, or the prize will be forfeited and, at Sponsor’s sole discretion, awarded to an alternate winner selected in a random drawing from among all remaining non-winning eligible entries received. By accepting a prize, winners consent to the use of their names, cities and states of residence, voices and/or likenesses by Sponsor and its designees for advertising, promotion, public relations, trade, or other purposes in commerce and in any and all media now known or hereafter devised, worldwide without territorial or time limitation or additional notice or compensation, except where prohibited.
8. By entering, each entrant agrees to abide by the terms of these Official Rules and by the decisions of the Administrator and Sponsor, and agrees to release and hold harmless the Sponsor, Marketing Drive LLC, Rivet, and Administrator, and each of their respective parent companies, subsidiaries, affiliates and agencies, and all of the officers, directors and employees of each of the foregoing (collectively, “Released Parties”), from and against any and all liability arising from or in connection with participation in the Promotion or the acceptance, possession and/or use of any prize (including any travel/activity related thereto).
9. The Promotion is subject to the Sponsor's Privacy Policy, available at http://www.exxonmobil.com/Global-All/Legal/privacy.asp. Please review this privacy policy for a description of how personal information collected in connection with this Promotion may be used.
10. By participating, entrants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, this Promotion or the prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Fairfax County, Virginia; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering this Promotion and in no event will entrant be permitted to obtain attorneys' fees or other legal costs; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants' rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.
